A cute pun lands a small Brooklyn-based company a lawsuit.
Rock and Roll Hall of Fame inductees Daryl Hall and John Oates are taking on a small, independently owned... Brooklyn granola company? Early Bird produces small batch artisan granola—but the problem here is that one product is sold under the (cute!) name "Haulin' Oats" and Hall and Oates can't, uh, go for that.
“The name and mark Haulin’ Oats is an obvious play upon Plaintiff’s well-known Hall & Oates mark, and was selected by defendant in an effort to trade off of the fame and notoriety associated with the artist’s and plaintiff’s well-known marks," reads the federal lawsuit the duo has filed.
Hall and Oates are now seeking damages and want the company to change the name of their granola. Aw, it's just a pun, dudes. :(
